   3 The software which accompanies this license (the "Software") is the
   4 property of SoftMaker Software GmbH ("SoftMaker") or its licensors and
   5 is protected by copyright law. While SoftMaker continues to own the
   6 Software, you will have certain rights to use the Software after your
   7 acceptance of the license. Except as may be modified by a license
   8 addendum which accompanies this license, your rights and obligations
   9 are as follows:

  14 By using, copying, transmitting, distributing or installing the
  15 Evaluation Software, you agree to all of the terms of this License. If
  16 you do not agree to any of the terms of this License, then do not use,
  17 copy, transmit, distribute, or install the Evaluation Software.

  19 This is not free software. Subject to the terms below, you are hereby
  20 licensed by SoftMaker to use this software for evaluation purposes
  21 without charge for a period of 30 days. If you use this software after
  22 the 30 day evaluation period you must purchase the software. Payments
  23 must be in Euros or US Dollars, and should be sent to SoftMaker
  24 Software GmbH, Kronacher Straße 7, 90427 Nürnberg, Germany. See the
  25 SoftMaker web site at http://www.softmaker.com for information about
  26 online ordering.

  28 Unregistered use of the Evaluation Software after the 30-day
  29 evaluation period is in violation of U.S., German, and international
  30 copyright laws.

  32 You may, without making any payment to SoftMaker:

  34 a) give exact copies of this version of the Evaluation Software
  35 personally to anyone, except for the purpose of extending their 30-day
  36 evaluation period;

  38 b) distribute exact copies of this version of the Evaluation Software,
  39 if done exclusively through electronic channels; and
  40
  41 c) make as many exact copies of this evaluation version of the
  42 Evaluation Software as you wish, for purposes of distribution as
  43 described in (a) and (b) above.

  45 You are specifically prohibited from charging, or requesting
  46 donations, for any copies, however made, and from distributing such
  47 copies with other products of any kind, commercial or otherwise,
  48 without prior written permission from SoftMaker. SoftMaker reserves
  49 the right to revoke the above distribution rights at any time, for any
  50 reason or for no reason.

  52 This software, and all accompanying files, data and materials, are
  53 distributed "AS IS" and with no warranties of any kind, whether
  54 express or implied. In particular, there is no warranty that the
  55 software is or will be free from defects. Good data processing
  56 procedure dictates that any program be thoroughly tested with
  57 non-critical data before relying on it. The user must assume the
  58 entire risk of using the program. This disclaimer of warranty
  59 constitutes an essential part of the agreement. In no event shall
  60 SoftMaker, or its principals, shareholders, officers, employees,
  61 affiliates, dealers, suppliers, contractors, subsidiaries, or parent
  62 organizations, be liable for any incidental, consequential, or
  63 punitive damages whatsoever relating to the use of the Evaluation
  64 Software, or your relationship with SoftMaker, even if we have been
  65 advised of the possibility of such damages, or they are
  66 foreseeable. Our maximum aggregate liability to you and that of our
  67 principals, shareholders, officers, employees, affiliates, dealers,
  68 suppliers, contractors, subsidiaries, or parent organizations, shall
  69 not exceed the amount paid by you for the Software. The limitations in
  70 this section shall apply whether or not the alleged breach or default
  71 is a breach of a fundamental condition or term or a fundamental
  72 breach. Some states or countries do not allow the exclusion or
  73 limitation of liability for consequential or incidental damages, so
  74 the above limitation may not apply to you.

  76 In addition, in no event does SoftMaker authorize you to use the
  77 Evaluation Software in applications or systems where the Evaluation
  78 Software's failure to perform can reasonably be expected to result in
  79 a significant physical injury, or in loss of life. Any such use by you
  80 is entirely at your own risk, and you agree to hold SoftMaker harmless
  81 from any claims or losses relating to such unauthorized use.

  83 This Agreement is the complete statement of the Agreement between the
  84 parties on the subject matter, and merges and supersedes all other or
  85 prior understandings, purchase orders, agreements and
  86 arrangements. This Agreement shall be governed by and construed in
  87 accordance with the laws of the Federal Republic of Germany. Exclusive
  88 jurisdiction and venue for all matters relating to this Agreement
  89 shall be in courts located in the City of Nürnberg, Germany, and you
  90 consent to such jurisdiction and venue, thereby excluding the United
  91 Nations Convention on Contracts for the International Sale of Goods
  92 and any legislation implementing such Convention, if otherwise
  93 applicable.

  95 If any provision of this Agreement is declared by a Court of competent
  96 jurisdiction to be invalid, illegal, or unenforceable, such a
  97 provision shall be severed from the Agreement and the other provisions
  98 shall remain in full force and effect.

 100 All rights of any kind in the Software which are not expressly granted
 101 in this License are entirely and exclusively reserved to and by
 102 SoftMaker. You may not rent, lease, modify, translate, reverse
 103 engineer, decompile, disassemble or create derivative works based on
 104 the Software. You may not make access to the Software available to
 105 others in connection with a service bureau, application service
 106 provider, or similar business. There are no third party beneficiaries
 107 of any promises, obligations or representations made by SoftMaker
 108 herein.

 110 U.S. GOVERNMENT RIGHTS: With respect to any acquisition of the
 111 Software by or for any unit or agency of the United States Government
 112 (the "Government"), the Software shall be classified as "commercial
 113 computer software", as that term is defined in the applicable
 114 provisions of the Federal Acquisition Regulation (the "FAR") and
 115 supplements thereto, including the Department of Defense (DoD) FAR
 116 Supplement (the "DFARS"). The Software was developed entirely at
 117 private expense, and no part of the Software was first produced in the
 118 performance of a Government contract. If the Software is supplied for
 119 use by DoD, the Software is delivered subject to the terms of this
 120 Agreement and either (i) in accordance with DFARS 227.7202-1(a) and
 121 227.7202-3(a), or (ii) with restricted rights in accordance with DFARS
 122 252-227-7013 (c)(1)(ii)(OCT 1988), as applicable. If the Software is
 123 supplied for use by a Federal agency other than DoD, the Software is
 124 restricted computer software delivered subject to the terms of this
 125 Agreement and (i) FAR 12.212(a); (ii) FAR 52.227-19; or (iii) FAR
 126 52.227-14(ALT III), as applicable. The manufacturer is SoftMaker
 127 Software GmbH, Kronacher Straße 7, 90427 Nürnberg, Germany.
