5 Software License Agreement
6 IMPORTANT - READ BEFORE COPYING, INSTALLING OR USING.
8 Do not use or load this software and any associated materials
9 (collectively, the "Software") until you have carefully read the
10 following terms and conditions. By loading or using the Software, you
11 agree to the terms of this Agreement. If you do not wish to so agree,
12 do not install or use the Software.

20 2.1. This is your license from Intel Corp. under its intellectual
21 property rights. You may have additional license terms from the party
22 that provided you this software, covering your right to use that
23 party's intellectual property rights.
25 2.2. Intel grants, free of charge, to any person ("Licensee")
26 obtaining a copy of the source code appearing in this file ("Covered
27 Code") an irrevocable, perpetual, worldwide license under Intel's
28 copyrights in the base code distributed originally by Intel ("Original
29 Intel Code") to copy, make derivatives, distribute, use and display
30 any portion of the Covered Code in any form, with the right to
31 sublicense such rights; and
33 2.3. Intel grants Licensee a non-exclusive and non-transferable patent
34 license (with the right to sublicense), under only those claims of
35 Intel patents that are infringed by the Original Intel Code, to make,
36 use, sell, offer to sell, and import the Covered Code and derivative
37 works thereof solely to the minimum extent necessary to exercise the
38 above copyright license, and in no event shall the patent license
39 extend to any additions to or modifications of the Original Intel
40 Code. No other license or right is granted directly or by implication,
41 estoppel or otherwise; The above copyright and patent license is
42 granted only if the following conditions are met:
46 3.1. Redistribution of Source with Rights to Further Distribute
47 Source. Redistribution of source code of any substantial portion of
48 the Covered Code or modification with rights to further distribute
49 source must include the above Copyright Notice, the above License,
50 this list of Conditions, and the following Disclaimer and Export
51 Compliance provision. In addition, Licensee must cause all Covered
52 Code to which Licensee contributes to contain a file documenting the
53 changes Licensee made to create that Covered Code and the date of any
54 change. Licensee must include in that file the documentation of any
55 changes made by any predecessor Licensee. Licensee must include a
56 prominent statement that the modification is derived, directly or

59 3.2. Redistribution of Source with no Rights to Further Distribute

61 the Covered Code or modification without rights to further distribute

64 distribution. In addition, Licensee may not authorize further
65 sublicense of source of any portion of the Covered Code, and must
66 include terms to the effect that the license from Licensee to its
67 licensee is limited to the intellectual property embodied in the
68 software Licensee provides to its licensee, and not to intellectual
69 property embodied in modifications its licensee may make.

92 WILL NOT PROVIDE ANY UPDATES, ENHANCEMENTS OR EXTENSIONS. INTEL
93 SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY,
94 NONINFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.
96 4.2. IN NO EVENT SHALL INTEL HAVE ANY LIABILITY TO LICENSEE, ITS
97 LICENSEES OR ANY OTHER THIRD PARTY, FOR ANY LOST PROFITS, LOST DATA,
98 LOSS OF USE OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES,
99 OR FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF
100 THIS AGREEMENT, UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, AND
101 IRRESPECTIVE OF WHETHER INTEL HAS ADVANCE NOTICE OF THE POSSIBILITY OF
102 SUCH DAMAGES. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING THE
103 FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
105 4.3. Licensee shall not export, either directly or indirectly, any of
106 this software or system incorporating such software without first
107 obtaining any required license or other approval from the U. S.
108 Department of Commerce or any other agency or department of the United
109 States Government. In the event Licensee exports any such software
110 from the United States or re-exports any such software from a foreign
111 destination, Licensee shall ensure that the distribution and
112 export/re-export of the software is in compliance with all laws,
113 regulations, orders, or other restrictions of the U.S. Export
114 Administration Regulations. Licensee agrees that neither it nor any of
115 its subsidiaries will export/re-export any technical data, process,
116 software, or service, directly or indirectly, to any country for which
117 the United States government or any agency thereof requires an export
118 license, other governmental approval, or letter of assurance, without
119 first obtaining such license, approval or letter.
